The Trustees grant a licence for the placing and use of a mooring on the bed of Coniston Water on the following conditions:
1. All moorings shall be adequately spaced and subject to the final approval of the Trustees. The responsibility for this is the liability of the Licensee. Subject to this overall liability the mooring block should be a minimum weight of 400kg with the mooring chain of at least 10mm linkage. The mooring must be maintained in good order.
2. The Trustees shall be indemnified by the Licensee from and against all claims, proceedings, costs, damages and demands whatsoever arising from any damage caused by or use of the mooring or the boat moored thereto.
The Rawdon-Smith Trust and its agents have no responsibility for boats which come off their moorings.
3. No refuse, waste or sewage shall be placed or disposed of in the lake and every care must be taken by the Licensee to avoid any pollution of the lake.
4. The sub-letting of moorings or moored vessels is prohibited.
5. Moorings may be used by boats exclusively for private pleasure purposes only.
6. The right to moor a boat on Coniston Water is not transferable. Transfers with the sale of craft must be authorized in advance by the Lake Warden. If the mooring is relinquished the Trustees must be notified and the licence will then revert to the Trustees. The Trustees have the sole right to issue licences to moor on Coniston Water and any other persons exercising this right are in breach of the conditions of mooring in which case the mooring will be liable to forfeiture.
7. When an existing mooring holder sells a boat and the new owner wishes to continue to moor on Coniston Water, the Lake Warden must authorize the transfer and the existing mooring holder remains liable for all fees until the new owner completes and signs a mooring application, pays the fee and submits proof of insurance to the Lake Warden.
8. The rent for the licence is due in January and July each year. If this is not paid the Licensee will be deemed to have abandoned the mooring and shall have no further rights to use this. If the craft or other property is not removed, the Lake Warden may dispose of it in any way it deems fit without incurring any liability whatsoever to the Licensee.
9. Any breach of the terms herein renders the licence subject to termination when the licence reverts to the Trustees. In any other circumstances the licence may be terminated by giving not less than three months’ notice in writing to expire on December 31 yearly.
10. Any notice or communication sent by the Trustees shall be deemed to have been received by the Licensee if sent by ordinary pre-paid post to the last known address in the Trustee’s records. Communications shall be deemed to have been received by the Trustees if sent to them by ordinary pre-paid post, addressed to the Trust Secretary at the address to which the last payment of the licence fee was made. E-mail is an acceptable means of communication except in the case of original signed documents. In the case of terminations or sales, a return receipt should be requested. 11. The responsibility for making arrangements for the parking of vehicles, trailers and the storage of pram dinghies is a matter for the Licensee who must ensure that this has full local authority.
12. The Licensee must ensure that any boat using the mooring is adequately insured for third party risks to a minimum of £2,000,000. The Trust retains the right to request to see a copy of this insurance certificate at any time. Please note that all jetties, including pontoon jetties, should also be covered by 3rd party insurance to a minimum of £2,000,000.
13. The maximum size of boat permitted on the mooring is 26 feet overall this measurement being the total length of the hull and all its fittings including the pulpit and the rudder set at ninety degrees to the transom.
14. Invoices will be issued twice a year in January and July, and will be sent via email. Please arrange payment via bank transfer, within 14 days of date of invoice. A second invoice will be sent in July for the second half 6 month fee. Any queries please email treasurer@rstcharity.uk
Relinquishing Moorings
You are reminded that if you relinquish your mooring, you need to inform the Lake Warden in writing. Moorings are non-transferrable unless authorised by the Lake Warden in writing. When transferring moorings, the boat and mooring will remain your responsibility until the paperwork from the new mooring holder is received.
Mooring Numbers
For the 2024 season, the old sticker system has been ended and boat names/makes will now be the primary identifier for craft on the lake, so please ensure that any changes are communicated to the Lake Warden. A reminder, please make sure your mooring number is painted on your buoy. This is very important to enable people to identify the correct moorings. If you have not done this and someone else picks up your mooring then the Lake Warden won’t be able to help. This is the mooring holder’s responsibility. If your boat comes off the mooring the Boating Centre will struggle to find your mooring and you may be charged for a holiday mooring. Boats that can’t be identified and are left in a poor state may be sold and disposed of if the owners cannot be traced.
Late payments
Non-payment is considered a breach of the mooring conditions and the licence shall automatically terminate. The Lake Warden may dispose of the vessel in any manner it deems fit without incurring any liability whatsoever to the Mooring Holder.
Mooring Maintenance
Please ensure that your mooring is in good condition before you put your boat back on the lake in the spring. If you are leaving your boat on the water for the winter please make sure that it can be clearly identified. If it breaks its mooring and cannot be identified by the Boating Centre, Water Park or the Lake Warden, recovery won’t be carried out. Martin will undertake the majority of mooring maintenance from March 2024. Please inform him now of any works required to ensure maintenance has been carried out for the next season.
